Which state do you refer to? Years ago, I was in the Tyler Rose Garden and my boyfriend and I were walking in the yellow Texas Rose Section and my boyfriend picked me a yellow Texas Rose! As we were leaving, we saw this sign that said it was illegal to pick a rose! I was so horrified and so in love with my boyfriend so I hid the yellow rose inside my shirt! We joked about it for years! I think now upon reflection that if every person picks a rose in the Tyler Rose garden, the roses would all vanish! It is a law to protect certain gardens not all flowers!
Reply:In most states it is not. It might be illegal to collect ANY flowers in a state park or public garden and some states might have special protection for certain flowers but there is no nationwide law that prohibits picking state flowers.

The Colorado General Assembly wisely made it illegal to uproot the flower on public lands and the gathering of blossoms and buds is limited to 25 in one day. It may not be picked at all on private land without the consent of the landowner.





Another honor was bestowed on the Rocky Mountain columbine in 1915 when the song "Where The Columbines Grow" was adopted as the official Colorado state song.

Digging up an American Holly (state tree) or peach blossom (state flower) is not illegal, so there is no law to cite to. However, if you do not own the tree/flower, there are other issues. Destruction of property? Theft? Trespass to land? Am I going to soon read about some dummies in the News Journal?

Maybe there is a reason it grows wild in California; maybe it has not always grown wild there. I think it was planted there . .. .and native to possibly India, or it could have been the islands to the left of there where it originated. I could tell what I see as the mystery of the Golden Poppy; but it might differ from your own dreams or history. Because to know why it's the state flower, you might be interested in why it grows there also.

Is there a Kentucky law against digging up or destroying the Goldenrod plant since it is the State flower?

I am planning a senior prank. In some states it is illegal to dig up the state flower, so schools would be breaking the law by digging up flowers used as pranks at schools. You get the idea. Im wondering if this law exists in Kentucky referring to the Goldenrod. If it does, I would like to see proof of the law. Thanks.

There are more than 100 species of goldenrod native to Kansas. Kansas Revised Statutes 2.090 makes "goldenrod' the state flower, but does not say which one.





Some are protected species by federal and state law. You could not legally plant these for your prank.





Others have no protection at all so the school could dig them up whereever they find them.





Generally, if the law prevents the school from digging them up, it prohibits you from planting them in the first place.
