HELP! I desperatley need to know, Is it illegal to dig up the state flower/tree in Delaware?

HELP! I desperatley need to know, Is it illegal to dig up the state flower/tree in Delaware?
Is it on your land? If so not unless it has a specific preservation order.
Reply:If you get caught and the person wanted to press charges, Yes!


In fact, and I am smiling, while running around joyfully in the rain, in town, I started picking flowers from the city flower landscape design and a policeman threaten to take me to jail. I didn't know it was illegal.


Of course, this happened over 20 years ago. Thanks for the memory!

Reply:I said it before in the law and ethics section, and I'll say it again: there is no law specifically against digging up the American Holly (state tree) or Peach Blossom (state flower) in Delaware, so I can't give you proof. It's not like there is a law on the books saying "It is legal to dig up the state flower and state tree."


BUT, you said in the other section that it was for a senior prank.


If you do not own the flower/tree, then someone else does. Digging it up might be destruction of property. Getting to the flower/tree means you probably have to trespass. Even if it is on school grounds, you could be trespassing. If you take the flower/tree, it could be theft. Basically, DON'T DO IT.
